The Delhi High Court has held that hospitals are not liable for medical negligence. It is the doctors who treat patients who are liable. However, hospitals can be held liable if they fail to provide the basic infrastructure which results in harm to patients. Justice S. N. Dhingra gave this ruling while dismissing an order against Indraprastha Medical Corporation Limited passed by a lower court here holding it guilty of medical negligence in a case in which the patient had died due to wrong treatment given by a team of doctors at Apollo Hospital here.
